Colorado is a one-party consent state for recording calls. The old general duty to disclose AI interaction is gone; a patient notice about advanced technologies starts on 1 January 2027.

This is a guide for clinic owners, not legal advice. Every line points to the law or the regulator's own page, checked on 2026-10-21. Where we could not confirm something, the page says so.
Under the statute below, the consent of one party to the call is enough. Federal law lets a party to a call record it, so the federal rule applies the same way here. Wiretapping is committed only by a person who is not a sender or intended receiver.
Colorado no longer has a general duty to tell a caller they are speaking with an AI. In 2026 the legislature repealed and reenacted its AI law (SB26-189), taking effect on 1 January 2027. The new section 6-1-1704 is a notice that a deployer uses automated decision-making technology in a consequential decision. HIPAA covered entities and their business associates are exempt from the main sections, but only a provider operating from a location within Colorado. A covered entity must give patients a general notice of its use of advanced technologies, including covered automated decision-making technology. That is a patient notice, not a phone-line disclosure.
The Colorado Privacy Act does not apply to protected health information that a covered entity or its business associates collect, store and process. The exemption covers the information, not the clinic as an entity. See the AI disclosure answer for the 2027 patient notice. HIPAA still binds a covered clinic and its business associate vendor.
Colorado bars an automated dialing system with a prerecorded message for the purpose of soliciting someone to buy goods or services, unless there is an existing business relationship and the person called then consents to hear the message. It covers solicitation only. A violation is a petty offense. The federal rules on AI-voice calls and texts apply as well.
We found no statement from the Colorado Dental Board on AI agents. Our check was a web search, not a search of the board's own site, so this is not proof of absence.
We found no statement from the Colorado Medical Board on AI agents. The Division of Professions and Occupations legislative update lists HB26-1195, which concerns AI in psychotherapy only. Our check was a web search, not a search of the board's own site, so this is not proof of absence.
The federal rule applies here; nothing specific to this place was found.
The ADA requires a public accommodation to provide effective real-time communication, including text telephones and FCC-approved relay systems. A clinic phone line answered by an AI agent must still work for a relay caller.
Aida opens every call with the recording notice your province or state needs, and says it is the practice's AI agent wherever you want it to. Request a demo with your clinic's rules in mind.
