Maryland needs every party's consent to record a call. We found no state law that requires telling a caller they are speaking with an AI.

This is a guide for clinic owners, not legal advice. Every line points to the law or the regulator's own page, checked on 2026-10-21. Where we could not confirm something, the page says so.
Maryland makes interception lawful only where all of the parties to the communication have given prior consent, so recording a call needs every party's consent.
We found no state law that requires a business or health provider to tell a caller, texter or patient they are dealing with an AI. This rests on secondary trackers and web searches, not on the legislature's own search, so it is a finding of none found and not proof that none exists.
The Maryland Online Data Privacy Act exempts protected health information under HIPAA. The entity exemptions list government bodies, securities associations and financial institutions, not HIPAA entities, so the exemption is for the data, not the clinic. We read this in the enrolled bill, not the codified section. HIPAA still binds a covered clinic and its business associate vendor.
Maryland's Stop the Spam Calls Act, effective 2024-01-01, bars a telephone solicitation that uses an automated system for dialing or plays a recorded message without the called party's prior express written consent. A telephone solicitation is an organized activity to communicate by telephone with residents of Maryland in order to sell, lease or rent goods or services. A care reminder is not a sale, lease or rental, so it appears to fall outside. The federal rules on AI-voice calls and texts apply as well.
We found no statement from the Maryland State Board of Dental Examiners on AI agents. Its dental board page lists AI continuing education courses, not guidance. Our check was a web search, not a search of the board's own site, so this is not proof of absence.
We found no statement from the Maryland Board of Physicians on AI agents. Our check was a web search, not a search of the board's own site, so this is not proof of absence.
The federal rule applies here; nothing specific to this place was found.
The ADA requires a public accommodation to provide effective real-time communication, including text telephones and FCC-approved relay systems. A clinic phone line answered by an AI agent must still work for a relay caller.
Aida opens every call with the recording notice your province or state needs, and says it is the practice's AI agent wherever you want it to. Request a demo with your clinic's rules in mind.
