Delaware's two recording statutes conflict, so we cannot state a clean rule. We found no law that requires telling a caller they are speaking with an AI.

This is a guide for clinic owners, not legal advice. Every line points to the law or the regulator's own page, checked on 2026-10-21. Where we could not confirm something, the page says so.
Delaware's statutes conflict. 11 Del. C. 1335(a)(4) bars intercepting a message by telephone without the consent of all parties, including a private conversation. 11 Del. C. 2402(c)(4) makes it lawful to intercept where the person is a party to the communication or where one of the parties has given prior consent. We could not tell which controls, so we state no rule.
We found no state law that requires a business or health provider to tell a caller, texter or patient they are dealing with an AI. This rests on secondary trackers and web searches, not on the legislature's own search, so it is a finding of none found and not proof that none exists. Delaware HB 191 (Laws of Delaware vol. 85 ch. 250) bars a nonhuman entity, including an agent powered by artificial intelligence, from using nursing titles, with parallel changes for physicians and physician assistants. It does not require announcing AI status.
The Delaware Personal Data Privacy Act does not apply to protected health information under HIPAA. The entity exemptions in the same section list government, financial institutions, an insurance crime nonprofit and securities associations, and do not name HIPAA covered entities. The exemption is for the data, not the clinic. HIPAA still binds a covered clinic and its business associate vendor.
We found no Delaware autodialer statute in a law firm's state-by-state list. We did not search the official code, so a state telemarketer registration or home solicitation law may still reach commercial calls. The federal rules on AI-voice calls and texts apply as well.
We found no statement from the Delaware Board of Dental Examiners on AI agents. The Division of Professional Regulation's dental position statements page was returned in the search but its list was not opened. Our check was a web search, not a search of the board's own site, so this is not proof of absence.
We found no statement from the Delaware Board of Medical Licensure and Discipline on AI agents. Our check was a web search, not a search of the board's own site, so this is not proof of absence.
The federal rule applies here; nothing specific to this place was found.
The ADA requires a public accommodation to provide effective real-time communication, including text telephones and FCC-approved relay systems. A clinic phone line answered by an AI agent must still work for a relay caller.
Aida opens every call with the recording notice your province or state needs, and says it is the practice's AI agent wherever you want it to. Request a demo with your clinic's rules in mind.
