Nebraska is a one-party consent state for recording calls. A 2026 conversational AI law excludes business customer service use, so a clinic scheduling agent is probably outside it.

This is a guide for clinic owners, not legal advice. Every line points to the law or the regulator's own page, checked on 2026-10-21. Where we could not confirm something, the page says so.
Under the statute below, the consent of one party to the call is enough. Federal law lets a party to a call record it, so the federal rule applies the same way here.
Nebraska LB 525 (2026), the Conversational AI Safety Act, requires an operator to clearly and conspicuously disclose that a conversational AI service is artificial intelligence if a reasonable person would be misled to believe they are interacting with a human. The definition excludes a service used by a business solely for customer service or strictly to provide users with information about available commercial services or products. A clinic scheduling agent is therefore probably outside it. The AI provisions operate from 2027-07-01 per secondary sources, which we did not confirm in the text read.
The Nebraska Data Privacy Act does not apply to protected health information under HIPAA or to health records. The exemption is for the data, not for the clinic as an entity. HIPAA still binds a covered clinic and its business associate vendor.
Nebraska's telephone solicitation means a call or message using an automatic dialing-announcing device to encourage the purchase or rental of property, goods or services. It excludes a call to a person with whom the caller has an established business relationship, or one not made for commercial purposes. A separate section bars solicitation by such a device to any emergency or business line of a hospital, physician or medical service office or health care facility. The federal rules on AI-voice calls and texts apply as well.
We found no statement from the Nebraska Board of Dentistry on AI agents. Our check was a web search, not a search of the board's own site, so this is not proof of absence.
We found no statement from the Nebraska Board of Medicine and Surgery on AI agents. Minutes of its Board of Medicine and Surgery for 2024-02-09 record an update on an FSMB AI symposium, with no guidance. Our check was a web search, not a search of the board's own site, so this is not proof of absence.
The federal rule applies here; nothing specific to this place was found.
The ADA requires a public accommodation to provide effective real-time communication, including text telephones and FCC-approved relay systems. A clinic phone line answered by an AI agent must still work for a relay caller.
Aida opens every call with the recording notice your province or state needs, and says it is the practice's AI agent wherever you want it to. Request a demo with your clinic's rules in mind.
