This is a guide for clinic owners, not legal advice. Every line points to the law or the regulator's own page, checked on 2026-10-21. Where we could not confirm something, the page says so.
Montana bars recording without the knowledge of all parties (45-8-213(1)(c)). Two exceptions matter: persons given warning of the transcription or recording, and a health care facility's recording of a health care emergency telephone communication.
We found no state law that requires a business or health provider to tell a caller, texter or patient they are dealing with an AI. This rests on secondary trackers and web searches, not on the legislature's own search, so it is a finding of none found and not proof that none exists.
The Montana Consumer Data Privacy Act exempts a covered entity or business associate as defined in the HIPAA privacy regulations. We did not read the act's applicability thresholds. HIPAA still binds a covered clinic and its business associate vendor.
Montana bars an automated telephone system that plays recorded messages to offer goods or services for sale, to solicit information or to gather data or statistics. The section does not prohibit use to inform purchasers about the status of purchased goods or services, to respond to an inquiry the person started, or to provide other pertinent information when there is a preexisting business relationship. The federal rules on AI-voice calls and texts apply as well.
We found no statement from the Montana Board of Dentistry on AI agents. Our check was a web search, not a search of the board's own site, so this is not proof of absence.
We found no statement from the Montana Board of Medical Examiners on AI agents. Our check was a web search, not a search of the board's own site, so this is not proof of absence.
The federal rule applies here; nothing specific to this place was found.
The ADA requires a public accommodation to provide effective real-time communication, including text telephones and FCC-approved relay systems. A clinic phone line answered by an AI agent must still work for a relay caller.
Aida opens every call with the recording notice your province or state needs, and says it is the practice's AI agent wherever you want it to. Request a demo with your clinic's rules in mind.
