New York is a one-party consent state for recording calls. We found no New York law in force that requires telling a caller they are speaking with an AI.

This is a guide for clinic owners, not legal advice. Every line points to the law or the regulator's own page, checked on 2026-10-21. Where we could not confirm something, the page says so.
Under the statute below, the consent of one party to the call is enough. Federal law lets a party to a call record it, so the federal rule applies the same way here.
We found no New York law in force that requires telling a caller they are speaking with an AI. The synthetic performer law (General Business Law 396-b, chapter 617 of 2025) covers synthetic performers in advertisements, exempts audio advertisements, and does not cover phone customer service. The AI companion law (Article 47) excludes any system used by a business solely for customer service or strictly to provide users with information about available commercial services or products. Bill S8874, introduced 2026-01-13 and referred to committee, would add section 399-m-1; its text covers chat windows, websites and email.
We found no New York consumer health data statute in force that we could verify. The Health Information Privacy Act (S929) was vetoed on 2025-12-19 according to secondary sources, and revised bills were introduced in 2026 whose status we did not check. HIPAA still binds a covered clinic and its business associate vendor.
New York bars operating an automatic dialing-announcing device, or placing any consumer telephone call, except in accordance with the section. The section requires the device to state the caller's identity and purpose at the start and to disconnect when the person called hangs up, and bars random or sequential number generation. A consumer is a person solicited to buy, lease or receive a good or service, so the section is aimed at solicitation. Whether a care reminder is a consumer telephone call was not settled. The federal rules on AI-voice calls and texts apply as well.
We found no statement from the State Board for Dentistry (Office of the Professions) on AI agents. The search returned teledentistry guidelines only. Our check was a web search, not a search of the board's own site, so this is not proof of absence.
We found no statement from the Board for Medicine (Office of the Professions) and the Board of Professional Medical Conduct on AI agents. Our check was a web search, not a search of the board's own site, so this is not proof of absence.
The federal rule applies here; nothing specific to this place was found.
The ADA requires a public accommodation to provide effective real-time communication, including text telephones and FCC-approved relay systems. A clinic phone line answered by an AI agent must still work for a relay caller.
Aida opens every call with the recording notice your province or state needs, and says it is the practice's AI agent wherever you want it to. Request a demo with your clinic's rules in mind.
